This page reflects the incompetence of the investigator for OSHA.

OSHA knew that food product and hazardous waste, as well as asbestos were being hauled in these trailers and chose to do nothing.(My complaint to OSHA alerting them to this)

Reading these documents you will find that OSHA was so incompetent that they could not get anything right; my name, the company's name, or other information that was critical to this case. I also became aware that OSHA only has 6 months to investigate a complaint from the day of the incident. If you look at the Letter to OSHA from MPC Trucking they made sure they waited until after the six months were up to reply.

October 9th was the first reply. In MPC's reply to OSHA you will see how Mr. Gallagher said I had an intestinal bacterial infection that was traced back to the well water contamination at my home (then) in Maple Crest, N.Y. This is not true. A test was done by Stiefel lab's because I did have an intestinal irritation and the doctor who was treating me suggested that I get the well tested so that source could be ruled out. Which it was. The report from A.C.Stiefel Research Institute shows that there was less than 2.2 per 100ml, which was the norm for when the test was done.

On October 12th Mr. Jim Kot's Reply to OSHA says that he researched exactly where the trailer had been prior to April 6,1992 but never gives documentation verifying this. He also states that he had the trailer swept under his supervision on April 10, 1992 and that the plastic bag of sweepings was stored near him until September 23,1992. I have a few questions:

1. Why wait from April 10th until September 23rd to get the sweepings analyzed when they were dealing with food product packaged in perforated plastic bags?

2. Mr. Kot dispatched me to Kimberton, Pennsylvania much later than April 10, 1992, (in fact it was 4/21/92), to inspect trailer 89111, which he told me nobody had touched, he wanted me to verify that this was the way I left the trailer. This is when I got my sample from the floor for my doctor. So how can we believe what is written here?

3. The Brandywine Research Laboratory, Inc results shows that MPC's sample was sweepings to a truck bed, but the report never identified the number of the specific trailer. How can we be sure that this sample came from this trailer?

4. Why did Mr. Gallagher's testimony at the Workmen's Compensation trial differ from the letter that he sent to OSHA on October 9, 1992?

Mr. Gallagher stated that there was nothing in the trailer at that time or previously that would have caused the type of illness that I was experiencing. But after doing research, I found that the styrofoam trays leech styrene which causes these exact symptoms. According to OSHA documentation, it caused the same symptoms I was having, looking like an intestinal bacteria infection.

In the closing letter from OSHA on November 16, 1992, OSHA stated that they closed their investigation on the grounds that the hazardous conditions have been corrected or no longer exist.

So, now I have a very crucial question.

Does this mean that MPC Trucking stopped hauling food product for WR Grace or any other food industries at this time?

This is exactly WHY Congress must pass this amendment I proposed to Congressmen Sweeny.
